Return Policy

Móveis Jota Barbosa, LDA. guarantees that all its services and products are in perfect conditions of use and according to the published technical characteristics. We assume to solve them quickly, within the legal framework and our possibilities.

Right of free resolution

Under the terms of Decree-Law No. 24/2014 of February 14, applicable to contracts concluded at a distance, the customer has recognized the right to give up the purchase made both in physical sales spaces as through the website of Móveis Jota Barbosa, LDA. and therefore, if not satisfied, you can return the product within a maximum period of fourteen calendar days counting

(a) the day on which the consumer or a third party, with the exception of the carrier, indicated by the consumer acquires physical possession of the goods, in the case of purchase and sale contracts;

(b) in the case of a service contract, from the day of conclusion of the contract

or

(i) the day on which the consumer or a third party other than the carrier and indicated by the consumer acquires physical possession of the last good in the case of multiple goods ordered by the consumer in one order and delivered separately,

(ii) the day on which the consumer or a third party, other than the carrier, indicated by the consumer acquires physical possession of the last lot or element, in the case of the delivery of a good consisting of several lots or elements,

(iii) the day on which the consumer or a third party other than the carrier and indicated by the consumer acquires physical possession of the first good in the case of contracts for regular delivery of goods during a specified period;

In order to exercise his right of free resolution, the client must indicate to Móveis Jota Barbosa, Lda his decision to resolve the contract by means of a declaration through the e-mail info@jotabarbosa.com, explaining the case in detail, indicating the order number and attaching photographs to verify the state of the goods that prove the reason for the return request.

For the deadline for free resolution to be respected, it’s mandatory that the communication regarding the exercise of this right by the customer is sent before the expiration of the respective deadline.

 

Effects of the free resolution

In case of resolution of the contract of purchase and sale of the products commercialized by Móveis Jota Barbosa, LDA, you will be refunded all payments made, excluding delivery costs, without undue delay and, in any case, no later than 14 days from the date you inform of the decision to terminate the contract. 

Móveis Jota Barbosa, LDA. will make such refunds through the payment method that the client used in the initial transaction, unless expressly agreed otherwise.

In the case of exhibition products, the client that wants to return that same product, incurs in a 5% tax over the product value, to cover the expenses for its removal.

Móveis Jota Barbosa, LDA., is only responsible for the expenses of return and reshipment, whenever there is an internal error and the product sent does not correspond to the one ordered or if the product presents origin defects.

If you receive an article damaged by the carrier, you will have 24 hours to claim from the date of delivery, sending photos showing the damage to the piece to info@jotabarbosa.com.

Exceeding this period of time, Móveis Jota Barbosa, LDA. is not responsible for any defect that may have happened by the transportation.

In case of desistance or mistake of the customer the return expenses will be of his entire responsibility. In this case, the client can effect the return of the articles through a carrier of its preference or request to Móveis Jota Barbosa, LDA. the collection of the products with an associated cost calculated to the date of the event.

Móveis Jota Barbosa LDA. accepts devolutions of products when done under the following conditions:

The return of products must be done in the same mode chosen by the client for the delivery.

The customer agrees to return the products in the conditions in which they were delivered, with the original packaging in perfect condition, or that have been used beyond having been tried. If the product to be returned is repackaged or not in its original and complete packaging, it will suffer a depreciation of its initial value, which will be deducted from the amount to be returned. The amount refunded for a product can never be more than the amount paid, otherwise the return will not be accepted.

Returns of custom-made goods, colors, or specific customer requests are not accepted. We also do not accept returns of goods with configurations (color, finish, dimensions, fabrics) that do not appear on any sales material or website.

In case the return is due to an internal logistic error and the product shipped does not correspond to the order or if the product presents origin defects, Móveis Jota Barbosa, LDA. will collect the goods, at the address indicated by the client, without any undue delay and, in any case, no later than 14 calendar days from the date you communicate us the decision to cancel the contract. It will be considered to have fulfilled the deadline if you return the goods before the end of such period; after contacting the client, Móveis Jota Barbosa, LDA. will proceed to collect the article, assuming the costs of the return, as well as the shipping costs of the correct product.

In the case of a return under the responsibility of the customer, mentioned above, the customer accepts without any restriction that the supplied products requiring assembly, by third parties, suffer in this process a wear that alters their initial delivery characteristics. The consumer will also be responsible for the diminished value of the goods resulting from handling other than that required to establish the nature, characteristics and function of the goods. In such cases, the customer accepts that Móveis Jota Barbosa, LDA. deducts from the reimbursement, an amount corresponding to the devaluation suffered by the goods in the process and never less than 25% of its sale value. 

The devolution and transport costs originated in case of drop out or client’s mistake, will be of the entire responsibility of the client. The direct costs of return will be borne by the customer in any case. The cost of the return will be the equivalent of the shipping costs without any applicable discounts or promotions. 

In the event of withdrawal, we will refund to you the payments made, excluding delivery charges, without undue delay and in any event not later than 14 calendar days after the date on which we are informed of your decision to withdraw from this contract.

We will make such a refund using the same means of payment used by you for the initial transaction; however, we will not be liable for any fees that result from such a refund. The client authorizes Móveis Jota Barbosa, LDA. to deduct from the reimbursement amounts, the amounts owed by the client that result from the application of the purchase contract conditions. 

Móveis Jota Barbosa, LDA. may withhold the reimbursement until receipt of the goods or until the client has presented proof of the return of the goods depending on which condition occurs first. 

Móveis Jota Barbosa, LDA. will refund the payment received from the client, without undue delay, before 14 calendar days have elapsed from the date the client has been informed of the decision to desist and after verification of the condition of the returned product. 

Móveis Jota Barbosa, LDA. will not pay the expenses of services already rendered such as removal of used products, postage, etc.

The customer should note all complaints on the transport document that accompanies the order. The customer may also make a complaint of an anomaly to the Customer Service, by e-mail to info@jotabarbosa.com, or by registered letter to the address: Móveis Jota Barbosa, LDA., R. do Multipark I, N 54, 4595-542, Seroa, Paços de Ferreira, Portugal.
